Accelitech Model Compliant with Final Ruling on Stark Law
On August 19, 2008, CMS published the final regulations for the Stark II Phase III law. Accelitech’s business model-partnering with hospitals and radiation oncologists to secure SRS and radiation therapy equipment-fits within the new Stark guidelines. The Stark Law prohibits physicians from referring Medicare patients to any entity for health services if there is a financial relationship between the referring physician or an immediate family member and the entity; however, the law allows for various exceptions in special circumstances.
The final regulations, which go into effect on October 1, 2009, state that radiation oncologists would be exempt from the Stark rule in cases where the patient needs radiation therapy.
